What are nonprofit organizations?

Formal organizations in the United States are typically thought about in three broad categories:

  • 1. Business and industry, or "for-profit" organizations
  • 2. Government, including state, local, and federal agencies that provide services and regulation
  • 3. Non-profit organizations, that qualify for tax-exempt status under the Internal Revenue Code because they are organized for the specific purposes stated in the Code.

Is there a definition of "gifted"?

Yes. The current federal definition of gifted students was originally developed in the 1972 Marland Report to Congress, and has been modified several times since then. The current definition, which is located in the Elementary and Secondary Education Act, is:

Students, children, or youth who give evidence of high achievement capability in areas such as intellectual, creative, artistic, or leadership capacity, or in specific academic fields, and who need services and activities not ordinarily provided by the school in order to fully develop those capabilities.

Note: States and districts are not required to use the federal definition, although many states base their definitions on the federal definition.

What is the best way to determine whether a nonprofit is a legitimate charity?

You can check the IRS “Select Check” website which will help you confirm whether the organization is recognized as tax-exempt by the IRS under Section 501(c)(3) or another section
